Boat Charter Waiver Form

Waiver and Release of Liability:
I, the undersigned, acknowledge and agree to the following terms and conditions for the boat charter provided by Lilo Noosa Private Charter:

Client Responsibilities:
a. The Client agrees to follow all safety instructions provided by the crew.
b. The Client is responsible for the conduct of all guests in their party.
c. The Client agrees not to exceed the maximum number of guests allowed (12).

Company Responsibilities:
a. The Company will provide a licensed Captain and Steward(ess) for the duration of the charter.
b. The Company will ensure the vessel is seaworthy and properly equipped for the charter.

Assumption of Risk:
I understand that boating involves inherent risks and hazards, including but not limited to, injury, drowning, or damage to property. I voluntarily assume all risks associated with the use of the boat.

Release of Liability:
I hereby release, waive, and discharge Lilo Noosa, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me while using the boat.

Indemnification:
I agree to indemnify and hold harmless Lilo Noosa, its owners, employees, agents, and representatives from any and all claims, demands, actions, or causes of action, and any resulting loss, damage, or injury, including death, that may arise out of or be related to my use of the boat.

Compliance with Laws and Regulations:
I agree to comply with all local, state, and federal laws and regulations related to boating and the use of the boat. I acknowledge that failure to comply with these laws and regulations may result in termination of the charter without refund.

Captain Authority:
I acknowledge that the Captain and Steward(ess) have full authority over the operation of the boat. I agree to follow all instructions and decisions made by the captain for the safety and well-being of all passengers and the boat.

Medical Conditions:
I certify that I am physically fit and capable of participating in the boat charter. I have disclosed any medical conditions that may affect my ability to safely participate in the charter.

Alcohol and Drug Use:
I acknowledge that the consumption of alcohol and drugs can impair my ability to safely participate in the boat charter. I agree not to use illegal drugs while on the boat and only consume alcohol provided by Lilo Noosa under the licensing laws.

Photography and Media Release:
I consent to the use of any photographs or video recordings taken during the boat charter for promotional or marketing purposes by Lilo Noosa.

Severability:
If any provision of this waiver and release of liability is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
